FDA 483 and Warning Letter Response

Response to a Form FDA 483 or a warning letter, built from FDA’s own procedures: the 15-business-day window, a cover letter, one identical table per observation (scope beyond the sample, root cause, correction, corrective and preventive action, evidence, owner, dates, effectiveness check), a commitments tracker, the content a warning letter asks for, an exhibit index, and the device feedback request under section 704(h)(2).

What a template is not

A template is a document baseline to adapt inside your own quality system. SPEQ does not approve, validate, or take responsibility for what you issue from it, and using one is not evidence of compliance.

PURPOSE

The written answer to an FDA inspection, organised so FDA can rely on it. A Form FDA 483 is not a final agency determination, and a response received within 15 business days of the end of the inspection is reviewed in detail before FDA decides whether to issue a warning letter. This template makes each observation answer the same questions, at the level of the system rather than the sample, with the evidence attached and the commitments tracked to completion.

What's Inside

✓Response dates: the inspection end date, the 15-business-day target, and any warning-letter deadline
✓Cover letter fields, including the FDA addressee and a senior management signatory
✓One identical table per observation: verbatim text, annotation, scope beyond the sample, root cause, correction, corrective and preventive action, evidence, owner, dates and effectiveness check
✓A commitments tracker for progress updates until each action is complete
✓Warning-letter additions: each step, its timing, reasons anything is incomplete, documentation, and reasoning where the firm disagrees
✓Exhibit index cross-referenced to observations
✓The device establishment request for nonbinding FDA feedback under section 704(h)(2)

How to Use It

1Fill in the dates on the day of close-out; the 15 business days run from the inspection end date.
2Scope each observation beyond the investigator’s sample before writing the root cause.
3Complete one observation table per observation, in the order of the 483, keeping the structure identical.
4Attach evidence for every completed action and give agreed dates for every open one.
5Have senior management sign, then submit within the window and send planned progress updates.
6If a warning letter follows, complete the additions section against the letter’s own instructions and period.

REGULATORY CONTEXT

FDA’s Investigations Operations Manual (2026, Chapter 5) governs how observations are written and annotated and tells investigators to advise firms of the 15-business-day window, which comes from FDA’s 2009 program on post-inspection responses (74 FR 40211). FDA’s Regulatory Procedures Manual (Chapter 4, Revision 12) sets the factors FDA weighs in a firm’s corrective action, what a warning-letter response should contain, and that a close-out letter follows only verified correction. Responding is voluntary and none of these documents prescribes a format; the per-observation structure is SPEQ practitioner synthesis.
