The amphetamine test is an in vitro diagnostic test for the qualitative analysis of amphetamine for employment and insurance testing. Any device that exceeds the limitations found in 21 CFR sections 862.9 to 892.9 or identified in the Federal Register (82 FR 31976) available at https://www.federalregister.gov/documents/2017/07/11/2017-14453/medical-devices-exemptions-from-premarket-notification-class-ii-devices is required to submit a premarket notification submission (510(k)) to FDA before introducing a device into interstate commerce. If a manufacturer’s device is exempt from the premarket notification requirement, then a premarket notification submission and FDA clearance is not required before marketing the device in the U.S. however, manufacturers are required to meet all other requirements under the Federal Food Drug & Cosmetic and implementing regulations including (but not limited to) registration and listing requirements. What these counts are not

Clearance and recall counts are SPEQ’s aggregation of FDA’s own published records for the code. A recall count is a measure of history, not of a device’s safety, neither number is an FDA rating, and SPEQ is not affiliated with the FDA.

What this classification requires

Every statement below is FDA’s own classification record for this product code, quoted from the device classification field reference. The SPEQ reading beneath each one is SPEQ’s interpretation of what it means for the work, and is not FDA text.

PREMARKET PATHWAY

510(K) Exempt

SPEQ READINGNo premarket notification is required for a device in this code, within the limitations of exemption. Exempt from premarket review is NOT exempt from regulation: registration, listing, labelling, adverse-event reporting and — unless the code is also GMP exempt — 21 CFR Part 820 all still apply.

DEVICE CLASS

Class II (moderate to high risk): general controls and special controls

SPEQ READINGSpecial controls are the distinguishing feature: performance standards, guidance documents, patient registries or postmarket surveillance named for the device type. Find the special controls before designing the test plan — they usually name the tests.

MALFUNCTION REPORTING

Device is not eligible for The Voluntary Malfunction Summary Reporting Program

SPEQ READINGIndividual malfunction reporting under 21 CFR Part 803 applies. The complaint-handling system has to produce a decision per event, not per period.

GMP / QUALITY SYSTEM

Not exempt due to Good Manufacturing Practice (GMP)/Quality System

SPEQ READINGThe full Quality Management System Regulation (21 CFR 820, incorporating ISO 13485:2016) applies, and is what an FDA inspection of this device will be conducted against.

IMPLANT

Device is not implantable

SPEQ READINGNo implant-specific expectations attach from the classification itself.

LIFE-SUSTAINING

Device is not used for life sustaining purposes

SPEQ READINGNo life-sustaining designation attaches to this code.

THIRD-PARTY REVIEW

Device is not a candidate for a third party review program

SPEQ READINGFDA reviews any premarket notification for this code directly.

21 CFR 862.3100 — Amphetamine test system

The classification regulation for this product code, as published by the Office of the Federal Register. This is the regulation text itself — no SPEQ interpretation appears in it.

(a) Identification. An amphetamine test system is a device intended to measure amphetamine, a central nervous system stimulating drug, in plasma and urine. Measurements obtained by this device are used in the diagnosis and treatment of amphetamine use or overdose and in monitoring levels of amphetamine to ensure appropriate therapy.

(b) Classification. Class II (special controls). An amphetamine test system is not exempt if it is intended for any use other than employment or insurance testing. The device is exempt from the premarket notification procedures in subpart E of part 807 of this chapter subject to the limitations in § 862.9, provided the test system is intended for employment and insurance testing and includes a statement in the labeling that the device is intended solely for use in employment and insurance testing.
